The plaintiffs claim against the defendants jointly and severally as follows; 1. A declaration that the compulsory retirement of the plaintiffs’ appointment under the defendants by the defendants is wrongful, illegal, unconstitutional, null and void and of no effect whatsoever. 2. A mandatory order on the defendants to re-instate the plaintiffs to his employment with full entitlements from the date of termination of the appointment till judgment and thereafter. The court(National Industrial Court) sitting in Ibadan, on the 26th of November 2012 granted the prayers of the plaintiffs and ordered that the defendants shall forthwith re-instate the claimants to their employment with full entitlements from the date of termination of the appointment till judgment and thereafter till he reaches the age of retirement. The defendants have failed and or refused to comply with the orders of the court despite the fact that the court of appeal sitting in Ado struck out their frivolous appeal. Now the plaintiffs have filed a motion before the National Industrial Court in Ibadan praying the court for an order committing the defendants-contemnors to prison for having disobeyed the order of the court. The defendants filled a notice of preliminary objection on the ground that the motion was not served on the chairman Local Government Service Commission. The court is to hear the motion and the preliminary objection together, if the application of the plaintiffs succeeds(which will), it goes to say that the defendants (Attorney General Ekiti State and The Chairman local Government Service Commission) will be committed to prison. The matter has been adjourned to May 19,2014 for hearing of the aforesaid applications.
