BETWEEN THE DEVIL AND THE DEEP BLUE SEA Cap 13 Sec 185 of the 1997 Constitution entrenches protection for certain Acts concerning Indigenous Fijians, Rotumans and Banabans. The entrenched provisions are in respect of the: Fijian Affairs Act Fijian Development Fund Act Native Lands Act Native Lands Trust Act Rotuma Act Rotuman Lands Act Banaban Lands Act Banaban Settlement Act These entrenched provision have been removed in the 2013 Constitution. The result is that with a 50 member Parliament, it only takes a minimum vote of more 25 members to amend these laws or do away with them altogether. With the enabling Acts gone, the issue of ownership of land by indigenous groups stipulated in the 2013 become meaningless. Think long and hard before you support the Fiji First Party. Right now, the indigenous people of Fiji, Rotuma, Rabi and Kioa are standing between the devil and the deep blue sea.
