BPAG NEWSFLASH Dear Residents and Friends, Great News! Today, BPAG took our case to the Court of Appeal and won the right to challenge the validity of Eastleigh Borough Councils grant of Planning permission for 1400 homes at Boorley Green. The Appeal Judge decided BPAG had an arguable case, around the way the report to the Eastleigh Council Committee dealt with the issue of alternative sites. The case will now go back to the High Court for the full Hearing. We will keep you advised. This was the best outcome we could have hoped for. BPAG are delighted the Court of Appeal have given us permission to take our legal challenge to a full Hearing. We have always believed we have an arguable legal case to challenge the premature grant of permission ahead of the examination of the Local Plan in public. We are convinced Boorley Green is not an appropriate option for development of this scale, due to its remoteness to services, transport and education, and the lack of infrastructure which is already overloaded.
