BREAKING NEWS PRESS STATEMENT TO INTERNATIONAL AND LOCAL MEDIA ON ICC AND AFRICA. EMBARGOED: 12.00 EUROPEAN TIME ON 6TH OCTOBER 2014 THE HAGUE NETHERLANDS: LAST JOURNEY OF FREEDOM AND JUSTICE FROM ICC: AFRICA AND ICC WHICH WAY! On behalf of Africa World Media Ltd and Pan African Forum Ltd, I will hold a press conference in The Hague on 7th October 2014 at 12.00 noon European time(Those journalists and other media in The Hague court will be informed directly of the venue) . The topic is the ICC and the way forward for Africa. I have been in the fore front in exposing the flaws in the OTP and how fake evidence , fake witnesses, and coached witnesses were assembled by the mortar machine called Luis Moreno Ocampo in 2008- 2009. GIVEN that some of us are a living testimony on how Ocampo wanted to use Article 70 to intimidate us when he was confronted about fake evidence in both cases but have no regrets for the harassment we received and continue to fight for the freedom of the suspects. We have not feared about the destiny but taken a step forward to tell the truth and nothing but the truth that the current Kenyan suspects are wrong ones whose evidence was obtained from the pork and meat joint of Nairobi. WE have traveled together on different routes with common purpose and as fighters of freedom against the ICC fake investigations, my position as a person who walked together with you on this journey , President Uhuru Kenyatta let us walk an extra mile to defeat lies of OTP. MR. President Uhuru Kenyatta there are friends who will tell lies to please you because they have syndrome of fakeness, there are friends who would like to cheer you even when you are dying, there are friends who wish for your down fall so as they inherit the Presidency, and there are those who are just on the fence waiting for leftovers and spoils. BUT there those like most of us who will never waffle, change, abandon, even if it means being jailed before you , there are those of us who have lost everything defending you even when we have never benefited, and that those of us who have stood by you together with family on ICC , NOW take a firm stand, start journey don’t mind the destiny. Humiliation comes before jubilation and as Jubilee we shall at the end of this trying moments in history triumph and defeat the enemies who plotted to select your name TAKING into account that Article 63 of the Rome statute is clear as it gives room for Judges to order the format when read together with Rule 134 of Rules and Procedure of the ICC court , and seeing what is on the ground here in The Hague , I believe the inner most heart of mine says , We take the journey and ask one question in daylight hours of Europe watched by billions of people : That if there is no evidence and no witnesses why are you holding me on the case ? This question can be asked directly to the Judges in Trial Chamber V (b), not when you are not present. SURPRISIGLY Article 53 is clear to my dear African sister Chief Prosecutor of ICC Fatou Bensouda who has no alternative but to tell the truth that she has no evidence , and also in the interest of Justice and the image of the court , she will move to terminate the case under 53. Chief Prosecutor will give alternative narrative to her version , where she will accuse the Kenyan government and media and so on about the her failures obstruction . I have received over 800 telephone calls from all over the world since yesterday 5th October 2014 inquiring about President Uhuru Kenyatta’s appearance in the ICC and about the Hague preparations. I want to make it clear that I am not spokesman of President Uhuru Kenyatta, neither Kenya Government Spokes man. I am a Pan African friend of President Kenyatta and all ICC suspects and as a volunteer who stands for international justice and transparency, which has been denied to the suspects, I request all those calling to direct their efforts to Kenya Embassy in Netherlands or State House Nairobi. . We stand for the truth that has been massacred by ICC OTP shoddy investigations in the Kenyan situation and we condemn the shame brought to this court by OTP. As law abiding citizens of the world let us follow all the judicial routes available to litigate our plight and seek redress from these same tormentors and encourage others to do so. We have together shown how politically this court could be but we are now left with a smaller legal leg that we need to accomplish on this journey. Let us not give Fatou Bensouda and the NGOs a life line to hang on! Dr. David Matsanga The Hague Netherlands 12.00HRS GMT 6TH OCTOBER 2014
