Big labor and the activists which supported these new regulations really made a mistake in not doing their homework better. From the beginning, many people were testifying that the new regulations were terribly flawed and wouldnt really work. Nevertheless, DOL and SEIU, et al., dug their heels in and forged madly ahead. Thankfully, a judge stepped in and said no! In my capacity as the Director of Policy for a not-for-profit organization which serves as the fiscal intermediary for more than 5000 direct care workers here in New York State, the new regulations were about to put us out of business, completely compromising the continuity of care of approximately 2600 people with disabilities. The only way that we would have been able to survive would have been if we capped hours of the workers, which would also compromise the continuity of care. Apart from the regulatory burdens, lack of funding and executive branch overreach, the part of this story which really got me angry was that big labor accused people like me, i.e., people with disabilities who depend on our workers, of not caring about our workers. That was utter bullshit and offensive.
