Excerpts: 8. Based on the two (2) charges by the National Fraud, and the further the Contempt Charges by the former Deputy Commissioner of Police, Mr.Simon Kaupa, it has affected my right, or interest to serve the Police Force but more importantly, it has enormously affected my constitutional duties to perform as the acting Commissioner of Police to serve the Police Force, and the people of Papua New Guinea. 9. Also, I am not able to effectively perform my Constitutional duties, or functions, in my capacity as the acting Commissioner of Police, because the Criminal Charges, have created animosity, and division amongst the members of the Police Force, therefore, I need sufficient tie (sic) to restore the integrity, and reputation of the Office of the Commissioner, but moreso, the Police Force as well. 10. As a result of the two (2) Criminal Charges, and the Contempt Charges, I have experienced or suffered, anxiety, emotional distress, frustration, and moreso, the action, and or conduct of the former Deputy Commissioner Police Operation, MR.SIMON KAUPA, and the Policemen involved in my arrest have intimidated me, which has demeanished (sic) my integrity, and status as a Senior experienced Police Officer and as the Acting Police Commissioner for 44 years, in the Police Force. 11. Thus, I honestly feel that, I do not have the right frame of mind to fully perform my responsibilities as the Acting Police Commissioner to administer, and assess the Investigation Report, in respect of the current Court proceedings, in an impartial and objective manner to assist the Court to determine whether or not it is appropriate to persue the Warrant of Arrest, or not based on the outcome of these proceedings. 12. In that respect, I humbly as (sic) the Court to grant the Application to discontinue or set aside the Warrant of Arrest.
