Being able to prove your case means more than just stating what you think happened or your version of the facts surrounding the car wreck. Rather, it means the ability to demonstrate to all, including the insurance company, that if this case becomes a lawsuit, you have the evidence to prove that their driver was negligent thereby causing the car wreck and the medical documentation to prove the extent of your personal injury claim. I am helping a friend right now with a case of disputed fault stemming from a car wreck. It occurred in one of the recent snowstorms here in Louisville so the police would not come and make a report. The question in this case was who crossed into the other driver’s lane of travel. While the other driver admitted fault at the accident scene, he is now telling his insurance company a different story. The problem for my friend is that until I can get that other driver’s insurance company to accept fault for this accident, her car goes unrepaired and they will not authorize a rental car. As a result, I am presenting them with photographs of the scene, a statement from my client and a statement from a witness. So my advice to you is that from the moment you are involved in a car wreck, start preparing for the fact that you could be in a lawsuit over it two years from now. While I understand this sounds extreme, it is what it takes to prevent this car wreck from being a nuisance for the next several years of your life. So assuming your injuries are not severe and require immediate attention, take pictures with your camera phone of the accident scene and the damage to the cars. If you were not at fault in causing this car wreck, turn on the recorder on your smartphone so you have a recording of the other driver admitting fault for this car wreck. Get the names, addressees and phone numbers of anyone who witnessed the accident. Take a picture of the license plate of all the vehicles involved in the car wreck and get from the at-fault driver, his name, address, insurance company and policy number. Yes, the investigating police officer should do the majority of these things as well. However, I have seen cases wherein witnesses were not listed on the police reports. Typically, you have 10 to 20 minutes before a police officer arrives at the scene of a car wreck. Why not use that time constructively and get your personal injury claim in order before the insurance company starts working against you?
