"The ‘endless access” to the Courts, as suggested by the Coalition in their policy document, ensures that the law is applied fairly and robustly, and is not a mechanism for asylum seekers to continually appeal. “In fact, the Courts are not able to decide if the asylum seeker should be granted refugee status, only if the decision maker applied the law properly. It is a checking mechanism to make sure there is independence and a clear line between the Government and the Judiciary, a cornerstone in any properly functioning democracy” “If such a system were suggested in any other area of law in Australia, there would be widespread outcry. Why do we think that people who are fleeing persecution deserve any less than an opportunity to be heard in a fair way?” Read more here....
