CASE FILED IN NATIONAL HUMAN RIGHTS COMMISSION ON 31.7.2014. HUMAN RIGHTS VIOLATION BY HEALTH & FAMILY WELFARE DEPARTMENT OF ODISHA (DEATH OF BELOW POVERTY LINE TRIBAL MAN OWING TO CARELESSNESS ACT OF HEALTH & FAMILY WELFARE DEPARTMENT OF ODISHA) One BPL card holder tribal man named Sukumar Jani, aged about 52 years, Village- Juraganda, Panchayat- Chadheyapalli, Block- Daspalla, District- Nayagarh, Odisha died owing to carelessness of doctor and other medical staff of Health & Family Welfare Department of Odisha. 1. On 27.7.2014 Sukumar’s health condition deteriorated while working in cultivation land and he went to Chadheyapalli Health Center for treatment but he found that the Health Center was locked hence he went to Daspalla Health Center for treatment but no doctor was available at the time he reached the hospital. At about 06 PM the doctor reached the hospital and the doctor left the hospital after prescribing medicine to Sukumar but Sukumar died after a few minutes. Tribal man Sukumar was BPL card holder 2. A lot of questions arises:- A) Why the Health Center was closed during day time in Chadheyapalli? B) Why no doctor was available in Daspalla Health Center when the victim reached the hospital. C) Whether correct medicines were prescribed by the doctor or not? D) Why doctor was not present near the patient as his health condition deteriorated? E) Once the cause of death was suspicious then whether postmortem was done or not? F) Whether Medico Legal case was registered by the hospital in nearest police station or not? 3. There is serious violation of Human Rights by the concerned medical staff and Health & Family Welfare Department of Odisha according to Article 21 & 14 of Constitution of India 1949. PRAYER 1. Urge the Commission to order the Government of Odisha to setup a high level inquiry committee to know the actual cause of death of the patient named Sukumar Jani and take action against the erring medical authority according to law. 2. Urge the Commission to order the Government of Odisha to pay compensation Rs 10,00,000/- (Rupees Ten Lakh) to the family of the deceased person and further pray to recover the amount of compensation(paid to the family of the victim) from the erring public servants of Health & Family Welfare Department of Odisha. 3.
