CHEN ADU Proposal for the LUDC Any responsible implementation of an Accessory Dwelling Unit (ADU) code in the City of Durango would include the following requirements: ADU Code Requirements: 1. Owner Occupancy: a. Owner would occupy the primary house or ADU as their permanent residence. b. ADU permit would follow the owner, not the property. Upon transfer of the property the new owner would have to permit the ADU under their name and they would have to reside on the property. 2. Land Use Development Code: a. A systematic code enforcement system that is not complaint based needs to be implemented by the City. b. All ADUs must be permitted and in compliance with the ADU code. c. No variances allowed for parcels with ADUs – this includes lot coverage and F.A.R. d. Special design requirements for ADUs to protect neighbors: i. Interior staircase for access ii. No decks or balconies above ground level iii. Windows designed to protect neighbors privacy 3. Lot Size and Density a. Minimum 5625 sq. ft. lot size in EN-1 north of College Drive b. Minimum 5000 sq. ft. lot size in EN-1 south of College Drive c. Minimum 7000 sq. ft. lot size in EN-2 d. A maximum density (to be determined) of ADUs per City block 4. Off-Street Parking: a. Two spaces for primary residence b. One space per ADU 5. Building Code Enforcement: a. Enforcement of life safety and building codes for all new and existing ADUs to include as a minimum: i. Electrical and natural gas code inspections ii. Smoke and carbon monoxide detectors iii. Proper egress / fire exiting iv. Sanitation 6. Permitting and Amnesty: a. Existing ADUs shall be brought into compliance with codes and permitted: i. Fees for water and sewer taps and plant investment fees shall be paid ii. Number of units per parcel and unrelated persons per dwelling determined to be in compliance iii. Owner-occupancy requirement met b. An amnesty period of time (to be determined) for existing ADU owners to either meet code or dismantle existing ADUs. c. Enforcement by the City with fines for non-compliance
