CLARKSTON, WA - A 31-year-old Clarkston man was arrested and 91 marijuana plants were confiscated following a report of a domestic dispute yesterday in the Clarkston Heights. Cody Matney was booked into the Asotin County Jail on charges of 2nd-Degree Assult-Domestic Violence, 2nd-Degree Malicious Mischief-Domestic Violence, 3rd-Degree Assault of a Child, Reckless Endangerment, and Manufacture of a Controlled Substance. According to a Probable Cause Affidavit, Asotin County Sheriffs deputies responded to a home on Reservoir Road at about 8:45 a.m. yesterday morning for a report of a possible physical domestic violence incident in progress. During the investigation, damage throughout the house and 106 marijuana plants were discovered. Matney told officials that he did have a medical marijuana permits which allowed him to possess 15 plants. Two children under the age of 10 were in the home at the time of the alleged incident and they reportedly told deputies that Matney started hitting one of them in the head with a tent pole, which was found laying on the floor of a bedroom, the affidavit says. The children also allegedly told deputies that they are often left to babysit the other children because the parents are always fighting or leave them. I could see marijuana and other items throughout the house in easy reach of the small children, the deputy wrote in his report. In the backyard, a deputy located two tents and he asked the children if they play in them. They said no the tents are for growing their dads plants. I could then see a large area filled with marijuana plants near the back of the house, the deputy stated. Plants were also allegedly found inside the home. I seized 91 of the marijuana plants and left 15 of the largest healthiest plants for Cody. I found two digital scales lying on the floor with other items there the area with a marijuana plants. They were near the entrance and were in plain view. I seized them as evidence. There was some dried marijuana lying in several areas in the open but it was in small quantities, the deputy says in the affidavit. He also estimated the damage to the doors, walls, bathroom wall mirror, and glass shelf to be approximately $1,200. The deputy contacted Child Protective Services and told them that based upon the easy access all of the children had to marijuana as well as dangerous sharp objects, trash, choking hazards and being left alone with a 9 and 7 year old providing supervision, the childrens statements about one of the children allegedly being hit in the head, and the evidence of domestic violence, that the two children that were in the home at the time would be taken into protective custody, as were other children who were in the mothers custody elsewhere.
