Changing the subject. Put the other side on the defensive. One proposal off the top of my head. Lets change the subject from damage caps to a Consumers right to know. Make it about informed consent. - - - Suppose the bill said this. Before any surgeon performs a surgery on a patient, the surgeon must disclose to the patient how many times he has performed that surgery. The surgeon must also disclose the outcomes of those surgeries. The hospital must disclose how many times that surgery has been performed on its premises in each of the preceding ten years and the outcomes. The hospital must disclose how many times the surgeon in question has performed the surgery on its premises and the outcomes. - - - The hospital can ask the surgeon this when the surgeon applies for privileges or for renewal of its privileges. It is easy. The hospital has it in its computers. Just give the patient a printout. - - Why should the hospital know when it grants privileges, but the consumer cannot know when the consumer is being sliced open?
