Charter Amendment resolution Per P.A. 279 of 1909, Section 117.21 (legislature.mi.gov/doc.aspx?mcl-117-21), amendments of a charter may occur either by an initiatory petition of the electorate or by the legislative body. In order for the legislative body to enact a charter amendment, it requires an affirmative vote of 3/5 of the legislative body. While the resolution passed with a majority vote (4 to 3), it did not meet the requisite 3/5 affirmative vote of the statute (it would have required 4.2 commissioners to affirm the resolution which equates to 5 commissioners). Based on the statute, there is no further action required with the resolution passed;
