Code A Day.. A brilliant way to help educate our members here and to share with others daily. .... 9.08.030 - Storage of junk material. A. Prohibited conduct. No person shall store in the open, nor shall the owner or person in control of any premises within the city permit to be stored in the open, any dismantled, partially dismantled, inoperative, wrecked or junked truck or motor vehicle of any kind, or any worn-out, cast-off or discarded material ready for destruction or collected for storage or conversion to some use. Each day that prohibited articles are stored contrary to the provisions of this section shall constitute a separate offense. B. Enforcement. All inspectional personnel, inspectors, commissioner, assistant commissioner, enforcement prosecutor, fire and police personnel shall be deemed to be enforcing persons for the purpose of this section. Violations of this section may be enforced in the manner provided in MGL chapter 40, section 21D. C. Penalty. Any person who violates this section shall be fined $100.00 per day for each day of violation. In addition to the imposition of said fine, the enforcing personnel shall have the power to seize any abandoned material stored in violation of this section and may, without liability to the city, destroy any such material if the owner cannot be located and the property is not claimed within 30 days of seizure.
