Coming up later: Section 122 (Continuation of all existing Judicial Appointments of Judges and Magistrates). Should the next elected government continue with regime appointed Judges given that they were not appointed by any independently constituted Judicial Services Commission? This includes the Chief Justice and the President of Court of Appeal. We should look at the key differences in the composition of Judicial Services Commission under the; 1. 2013 Regime Draft 2. 1997 Constitution 3. Yash Ghai Draft. Presently, the Chief Justice, President of the Appeals Court and the permanent secretary of justice (all regime appointees would become the three out of five members of the Judicial Services Commission under Regime Draft. The AG appoints two more persons to make up the five member Commission. How independent is that? So, should the elected government inherit judicial officers whose appointments were made without a independently appointed Commission who would then independently appoint Judges?
