“Conduct TET (Teachers Eligibility Test) every year in accordance with NCTE guidelines”-HC tells Punjab Government:- Justice Tejinder Singh Dhindsa, in his order has observed “It would be apposite to notice that under the Right of Children to Free & Compulsory Education, 2009, the Central Government has appointed the National Council for Teachers Education (NCTE) as the academic authority to lay down the minimum qualifications for persons to be eligible for appointment as a teacher. In the circular and guidelines issued by the NCTE and circulated to all the State Governments, certain directions have been issued for conducting the TET test, which is essential qualification for appointment as a teacher. Such guidelines, however,envisages that the appropriate Government would conduct TET test at least once every year. As such, it would be expected that the Government would comply with the directions issued by the NCTE and ensure the holding of the TET test once every year. Adherence to such exercise shall ensure that the prospective candidates for being appointed as teachers are not divested of the right of being considered for appointment.” In the aforesaid CWP, Parminderpal and some other persons had soyght issuance of appropriate directions to the State of Punjab for not proceeding further with the selection process for recruitment of 5078 “Rural Associate Teachers” initiated throiugh public notice dated Sept.9th, 2012, without first conducting the TET Test, since the State Government had not conducted the TET test during 2012. The State Government got the TET test conducted in June, 2013, during pendency of the aforesaid CWP and some other connected writ petitions, and declared its result also. The aforesaid petitioners, however, failed to qualify the TET test. In another connected CWP, however, Justice Dhindsa, issued an interim order to the respondents to permit one Manjot Singh, the petitioner,to participate in the selection process, subject to the final outcome of his writ petition. He had not earlier submitted his application, as he had not qualified the TET test before the last date for receipt of applications.
