Consumer forum slaps Rs 20L fine on pvt hosp for medical negligence The State Consumer Forum has slapped a fine of Rs 20 lakh to a private hospital for medical negligence causing and Rs 25,000 for mental agony suffered by the family of the victim during an operation for hernia. The order came against Pardaya Memorial Hospital, Sanganer, on a claim petition moved by one Vimal Kumar Mundra and others claiming compensation for ill treatment of his father T D Mundra. According Vimal, his father had hernia and was operated at the hospital on September 9, 2009 despite the fact that he was known to have high sugar levels due to his diabetes on the operation day. The surgery was carried out successfully but while after effects of the anesthesia was slowly wearing off and Mundra was becoming conscious, his oxygen saturation fell down critically causing brain hypoxia and he went into a coma. The patient remained in the coma and died ultimately on June 6, 2006. It was held by the consumer forum that the hospital was lacking life-saving equipment in its ICU and there was no ventilator system for artificial pulmonary revival, causing the patient to succumb to the coma. A three judge bench of the consumer forum headed by Justice Ashok Parihar said," In common medical parlance, small operations may appear to be simple, nevertheless, since anesthesia is given in most of the operations, there may be situation of complication and hospital should be fully equipped." The bench also noted the fact that due to lack of critical care facilities the patient was shifted to Santokba Durlabhji hospital, which took more than an hour, causing complications to patient and ultimately he died. Holding the hospital and its two doctors guilty of medical negligence, the bench directed a sum if Rs 20 lakh be paid as compensation and Rs 25,000 for mental agony of the family members of the deceased within a period of one month.
