Contract Administration & Dispute Resolution Scenario The company you work for is tendering for two new projects. One is to be under FIDIC 1999 “Red Book”, the other under the Hong Kong Standard Form of Building Contract Private with Quantities edition 2005. The managing director is familiar with one of these contract forms but not the other. Acting in the capacity as “Contract Manager” you are asked by the Managing Director to; Produce a professional report, critically comparing and summarising the two contracts in terms of their procedures and clauses so as he can then assess the risks involved with each contract for:- 1. Documents forming the Contract and their order of precedence/priority. 2. How variations are instructed and valued during the project. 3. Procedures necessary for claiming an extension of time. 4. Settlement of disputes including reference to designated representatives, dispute adjudication board, mediation and arbitration. Notes on Assignment: 1 References should be made to appropriate clauses, read the clause and rewrite in your own words. DO NOT REWRITE the clause, word for word. 2 References should be made to relevant timescales required within the procedures stipulated within the clauses. 3 It should be based on a comprehensive review of publications on the subject. Reference to relevant case law will improve your mark. 4 No tables are to be produced comparing clause for clause content, but text should be produced in the form of a report of sentences/paragraphs. 5 Harvard referencing system must be used WORD LIMIT: maximum of 3,000 words.
