Court declares 14 accused as proclaimed offenders Fugitives Asked To Appear Before Special Judge Anti-Corruption By April 24 Srinagar, Mar 26: A court here Wednesday issued ‘proclamation’ against 14 absconding accused beneficiaries in CET-2012 paper selling scam seeking their presence by or before next date of hearing on April 24. Special Judge Anti-Corruption Kashmir M L Manhas issued the proclamation on a motion by Crime Branch (CB) Kashmir seeking issuance of proclamation and attachment of property of the absconding accused under sections 87 & 88 of Criminal Procedure Code (CrPC). The court passed the proclamation after going through the relevant records produced by CB in support of its contention against the 14 accused named in supplementary chargesheet filed in the court on 1 March 2014. CB has pleaded that the earlier arrest warrants of court under section 512 of CrPC against the accused could not be executed as they were absconding. After taking the evidence on record in terms of the statements of the executing agency on oath, the court said it has reasons to believe that the accused against whom general warrants of arrest under section 512 of CrPC were issued have absconded or are concealing themselves, to avoid execution of the warrants against them. “Therefore, a written proclamation is issued/published requiring the absconding accused persons to appear before this court by or before 24 April 2014,” the court ordered adding one copy of the proclamation shall be publicly affixed on a conspicuous Mohalla, town or village in which the absconding accused persons ordinarily reside. It said one copy be affixed on the conspicuous part of the home/ residential houses of the absconding accused persons, while one copy shall be affixed on the conspicuous part of court premises at district court complex Srinagar. The court asked SSP, CB to comply with the court orders and get the proclamation published in widely circulated local dailies. Those against whom proclamation has been issued by the court are: Muhammad Amin Ganaie of Chee Anantnag, Mir Wajid Majeed of Wandevalgam-Kokernag, Mir Danish Majeed of Wandevalgam- Kokernag, Abdul Majeed Mir of Wandevalgam-Kokernag, Fida Hussain Lone of Kanellwan-Bijbehara, Ruhail Ahmad Mir of Gulberg Colony Hyderpora Srinagar, Muhammad Amin Mir of Gulberg Colony Hyderpora Srinagar, Hilal Ahmad Shokli of Mattan Chowk Anantnag, Imtiyaz-ul-Hussain Shah of Loharna Dacchan Kishtwar, Altaf Hussain Shah of Loharna Dacchan Kishtwar, Yasmin Jan of Rehbab Sahab Alikadal Srinagar, Arooj Mushtaq of KP Road Anantnag, Mushtaq Ahmad Kanue of K P Road Anantnag and Mushtaq Ahmad Dar of Sandoo Achabal. CB has filed supplementary charge-sheet against 19 persons before Special Judge anti-corruption Kashmir on 1 March 2014 out of which, 14 accused could not be presented before the court for being declared absconding.
