DIMARIA PREVENTS LICENSE SUSPENSION FOR MOTORIST WHO LEFT THE SCENE OF AN ACCIDENT In this case, Client hired DiMaria to represent him with regards to his ticket for leaving the scene of an accident. In New Jersey, a ticket for leaving the scene of an accident will lead to at least a six-month license suspension and two points on your license. The license suspension will be longer if someone is injured as a result of the accident. The license suspension is similar to that of a DWI, which results in a minimum seven months license suspension. “This is probably because many people who leave the scene of an accident do so in order to avoid a DWI”. There is a lesser-included offense to leaving the scene of an accident, which is failure to report an accident. Failure to report an accident rarely results in a license suspension and usually results in a monetary fine. Client was driving on the highway when he struck the median and pulled over to the shoulder. Client left his car on the shoulder and went to an undisclosed location. Nobody was injured in the accident. Police arrived to the scene and discovered that the car was registered in client’s parent’s name. Police went to client’s home but client was not home. Client’s parent was home asleep as it was 3:00AM. The police conducted an investigation and requested Client to come to the precinct for questioning. Client refused to give a statement. DiMaria and Client attended court nearly six times as the police officer who was handling the case truly believed that Client left the scene because he was drunk and therefore wanted to make sure that Client would receive a license suspension. DiMaria brought several documents to court on behalf of Client establishing that he was attending college, working two jobs, was a U.S. Citizen, and lived with his parents. After several negotiations between the officer, the prosecutor, and DiMaria the officer finally agreed to reduce the charge to failure to report an accident. Client did not receive a license suspension and paid a small monetary fine.
