Dear Paul: Thank you for contacting me regarding the Michigan Department of Educations (MDE) proposed rules on Special Education. In order to introduce or change administrative rules, the MDE is required to submit its draft for approval to the Office of Regulatory Reinvention. Once the draft is approved, it must then go to a public hearing. Following public hearing, the rules must be submitted to the Legal Services Bureau (LSB) for additional certification. Once the draft is certified, the rules are considered to have been formally submitted and are then sent to the Legislature where they are reviewed by the Joint Committee on Administrative Rules (JCAR). JCAR then has the ability to determine if an additional public hearing is required and also if legislation pertaining to the subject needs to be introduced. Currently, the MDEs rules, pertaining to Special Education, are awaiting ceritification. The Legislature cannot take action until the rules are formally submitted. There is no timeline for the certification process, but I am aware of the many concerns surrounding these rules. The MDE can make changes to the rules before they are formally submitted. ****I am continuing to monitor this situation and will likely hold a hearing if no changes are made.**** Thank you again for contacting me, I will keep your thoughts in mind as the administrative rules promulgation process continues.
