Dear fellow Alta Sierrans, We just received an e-mail from Mr. Peter Lemmon, the board’s attorney, saying: As to the ‘Recall Petition,” that petition is, in my opinion, an ineffective “petition” since there is no provision for recalling a board of directors via such a petition. Mr. Lemmon gives no explanation and offers no excuse. His “opinion” is a refusal to allow the voice of the community to be heard to keep the board in “power.”. It is in effect saying,” We refuse to acknowledge the recall petitions and if you don’t like it, Sue us.” This arrogant refusal comes after we have presented far more signatures than needed, and the signatures were validated by the ASPOA secretary. At the last board meeting, President Paul Hoefler himself admitted that the recall petitions were valid and the threshold met. As of July 1, the ASPOA board has spent over $20,000 in legal fees. The board of directors is plundering our treasury. They are making it clear they are willing to waste it all to cling to their positions. They seek to prevail through spending their opponents into the ground….their opponents being their own members and neighbors. This is a sad day for Alta Sierra. The ASPOA board appointed themselves – and are clearly afraid to hold the free and open elections that a recall required. This is an insult to the spirit of democracy. Is it any wonder Alta Sierrans are so opposed to the notion of a mandatory HOA controlled by such a wasteful and tone-deaf clique of 9 people? Not another penny of ASPOA funds should be spent on attorneys’ fees. This board must be recalled. They break their own rules. They are contemptuous of their membership and have betrayed the best interests of the association. They have lost the trust and confidence of the community. By spending a fortune on attorneys’ fees, they have already crippled ASPOA’s ability to serve our community. We are now carefully reviewing our options with legal advice, including remedies that will require the board members to repay the funds they have squandered. We will keep you informed of our progress. What can you do right now? 1. Email the board and ask them to RESIGN. Demand that they not spend one more penny on attorneys’ fees.
