Dear friends, I have sent a PIL to the Supreme Court of India. The subject matter is being posted herebelow. I request all the citizens of India to send the same PIL to the Supreme Court of India. I havent received any communication from the Supreme Court, till date. ---------------------------- IN THE SUPREME COURT OF INDIA To, The Chief Justice of India and the Companion Justices of the Supreme Court of India New Delhi, India Pin code – 110 201 Sub. – Public Interest Litigation for Political Inclusion of Govt./Semi Govt./PSUs/PSB employees Without prejudice and with all respect to the court of the Chief Justice of India, the Constitution of India & the Govt. of India, this is regarding Political Inclusion of various Govt./Semi Govt./PSU/PSB employees/officers, who are not allowed to take part in various political activities, except to vote, without losing their livelihood. 1. Presently, without specifying proper reasons, in an undemocratic manner, these groups of Indian Citizens i.e. employees of Govt./Semi Govt./Public Sector Undertakings/Public Sector Banks are barred from taking part in political activities, viz. Joining and forming a political party, Contesting elections for Parliament, Legislative Assemblies/Councils and others like these, without losing their livelihood. Due to this prohibition, country is suffering badly on every front and the experiment of keeping these groups away from political activities have failed miserably. People with criminal orientation have taken advantage of this situation and have occupied the controls of the most of the democratic institutions in the country, using undemocratic means; promoting and supporting various social and political evils of public life, viz. Communal Hatred, Casteism, Regionalism, Bribe to voters and all types of Crime & Corruption etc. It has become difficult for law abiding, honest, patriotic, peace loving, secular citizens of India, to live with dignity, happiness, safety and fearlessness, in a real democratic manner. Citizens are living under unbearable social, economic & political conditions. 2. Due to this prohibition their status in the Indian Society is of Third Rate Citizens. (First rate citizens – Who enjoy all types of political, social and economic rights and support of political system; Second Rate Citizens - Who are denied political rights except to vote, but, fulfill their needs, happiness and comforts through corruption. They also, have good tuning with the First rate citizens). These Third Rate Citizens are attacked and harassed, now and then, by various evil forces of Indian Society and unable to get protection & justice, due to almost all round corruption in Police, Polity and Judiciary. They and their offspring are deprived of various opportunities of development and comfortable living due to imbalance in citizen’s rights. So, it can also, be said that these Third Rate Citizens are living, almost, like real slaves. 3. Over the years, these Third Rate Citizens have developed themselves in a much better way and are used to have much higher levels of talent, and positive, peace loving, law abiding attitude as compared to the First Rate Citizens. Barring a few, most of these Third Rate Citizens are the Real Seculars & Real Nationalists; and serving all groups of the Indian Society with equal pleasure and brotherhood feelings all over the nation. Keeping them out of the political system except to vote is deliberate disservice to the Nation. 4. Under Art.19 of the Constitution of India, an Indian Citizen is conferred various fundamental rights, e.g. Freedom of speech & expression, Freedom to assemble peacefully, Freedom to form associations and unions, and a few others. States have been allowed only, to use their authority, to restrict these provisions of Freedom in the interests of the sovereignty and integrity of India or public order or morality; and not to misuse it. Imposing the restrictions on Third Rate Citizens seems to be the misuse of this authority conferred by the Constitution of India, as there is no Third Rate Citizen, who is a threat to the sovereignty and integrity of India or Public order or morality. While a huge number of First Rate Citizens appears to be the real threat to the sovereignty and integrity of India, public order or morality and also, the national harmony. So, various governments and organizations are practicing in an unconstitutional and undemocratic manner while imposing such prohibition through various employee conduct rules. 5. Most of our Trade Unions are allowed to have affiliation with various political parties, and sometimes, a few officials and members of these trade unions, belonging to Second & Third Rate Citizens’ Groups, are seen promoting the political parties that their trade unions are affiliated with. Hence, the purpose of keeping the individuals away from active politics without losing their livelihood fails and becomes tantamount to the discrimination on the grounds of the faith and profession. 6. Allowing these Third Rate Citizens to vote, motivates them to keep political leaning. This again defeats the purpose of keeping them out of the active politics without losing their livelihood, if they are expected not to keep any political leaning. 7. I had written to the Prime Minister of India in this regard on 21.12.2013. His office forwarded it to The Secretary, Department of Personnel & Training, Ministry of Pers. P.G. & Pensions. It is more than two months I had written to them, I have not received any communication from them till date, while the Election Commission has started, already, the election process for next Parliament and various State Assemblies. Hence, I presume that it is a deliberate delay on the part of the Government of India, to bar these deprived Indian citizens from using their democratic rights in the coming election process for Parliament and various Legislative Assemblies. 8. A system of Plutocracy, in the name of Democracy, has been established in India, practically, by the forces and authorities, including the Election Commission of India, who have been managing and controlling the election process in the country for election of people’s representatives for the Parliament and various State Assemblies. Apart from the above mentioned prohibition in the case Govt./Semi Govt./PSUs/PSB employees, it is very much evident, also, from the fact that the Election Commission of India has been keeping the limits of election expenses too high for an individual and well beyond the reach of more than 99% (approx.) citizens of India to participate and contest the elections for Parliament’s or various Legislative Assemblies’ Representatives. Recently, the Election Commission has increased this limit to Rs.70.00 Lacs for a Parliamentary constituency and Rs.28.00 Lacs for an Assembly constituency, thus, practically, creating a bar for most of the Indian Citizens to contest these elections, who can not earn this much amount in whole of their life time; and promoting and supporting the Plutocratic system of elections and governance. Hence, keeping all the above in view, I apprehend that the above mentioned Third Rate Citizens (also, the Second Rate Citizens) are being kept out of the active politics, deliberately, under some motive of conspiracy, just to harm the nation, its secular nature and the national harmony, with all the ill feelings towards the people of India. Hence, I request your court – 1. to quash these provision of prohibition and any other law which is a hindrance in the way of these Second and Third Rate Citizens, except Judicial Officials, to join a political party, to form a political party and to contest various elections to chose people’s representatives for Parliament, Various Legislative Assemblies/Councils and other bodies, for the good of the Nation and Democracy and to save these from various social, economic and political evils. Support me. 2. to put a stay on the coming elections for Parliament and various State Assemblies, atleast, for 6 months to allow enough time to presently deprived Indian Citizens for preparing to contest the elections. 3. to quash the huge amount of Spending Limit of Rs.70.00 Lacs for a Parliamentary constituency and Rs.28.00 Lacs for an Assembly constituency. None should be more than six times of the National Per Capita Income per month, and while calculating the National Per Capita Income, the income produced by the billionaires of the country should be kept aside.
