Dear friends, This is the email I had sent to the Chief Justice of India on 15/11/2011 To The Chief Justice of India New Delhi . Sir, Laal Salaam. Shouldn’t you be ashamed of your high court judge, who, when thousands of unpaid NREGA LABOURERS pray before him for the payment of their due wages vide W.P.(C) No. 5969 of 2008 of Jharkhand High Court, mischievously shows his teeth and insists that it is a money suite not befitting the dignity of the High Court? Shouldn’t you again be ashamed of the fact that thousands of these innocent labourers are still left unpaid for the hard work they had done more than 3 years hence? Shouldn’t you again be ashamed of the fact that just on the 1st hearing day of the above case, the administration hurriedly files an FIR and your judiciary sends me jail and is still trying me for a matter which should rather have fetched me a national award? Shouldn’t you again be ashamed of your judiciary still trying me on another charge that soon followed of my being a naxal under 17 and 18 CL acts even when the police officer who had arrested me from my sweet home has already been found guilty by his headquarters and was suspended for ingenuously tempering police records to cover up for the bullets he had shown to have recovered from my body at the time of my arrest? In the year 2007-08 the government had given a huge gift of Rs.120 crore to Gumla district under NREGA. Today, more than Rs.100 crore of this huge gift has been wasted. Rs.20 crore of this waste was due to corruption in lower bureaucracy. I was the whistle-blower and had confessed in writing in January, 2008 itself of having had to pay bribes to officials for the release of signed cheques. The administration had found my confession true and referred it for further action to the state government. The constitution of India holds bribe giving to be as much a crime as bribe taking is. Today I should have been the happiest Indian had I been in jail for this bribe giving. Another Rs.80 crore of the waste was cleverly engineered by Duryodhan (Himani-Rahul) in an effort to make naked a poor Draupadi (Aradhna-Kamal) so as to avenge for her laugh when they had had a slip at LBA, Mussourie, in their training days. My FAST UNTO DEATH in September 2008 to stop this huge waste was brutally crushed on the 5th day. Alas, your judiciary should have seen how, when even after rigorous audit they couldn’t find any fault in our accounts, even after hundreds of sorties to physically verify each of our purchases at the source they couldn’t find a single mistake, sinisterly the administration, after six month field verification by a team of 50 officials, declared half of our lush green plantations, that had fetched us a prestigious award from a National Institution, null and void, just because the poorest tribal beneficiaries of this most malnourished district in the world couldn’t read or write and had erroneously misquoted just the plot numbers of their plantation fields. Alas, your judiciary should have seen how thousands of labourers had then come out to help and continued work for one year one month and 12 days WITHOUT ANY WAGES guarding our lush green plantations (which we had worked out with just 50% of the funds) until the day I was declared a naxal and arrested a second time. That very night the whole of our lush green fields, painfully created by more than one lakh twenty thousand mandays, had been grazed by marauding stray cattles and reduced to dust. That very night our Nursery with 50 lakh saplings ready to replace the casualties was also destroyed. Gandhari should have been the eyes to the blind king. Mr.Chief Justice, please wake up to the orgy in your courtrooms, how lawyers are being managed, how cannibals are feasting on the corpses of starving labourers, how the bureaucracy has started pissing on the institutions of the Vidhan Sabha, the Home Minister and even the Vice President of India. We are sorry, the judiciary in independent India has become the greatest and easiest weapon of the powerful to harass and torture the innocents. As the government of the day has already declared me a naxal a good two and a half years back, and as my appeals to the highest office of the Home Minister of India has gone unheard for the last two years, I now hereby use my logical right to demonstrate before Your Lordship how the Minister feels when just the tip of my pen goes red. Today, sitting in meditation in the caves of the historical Rishyamuk Mountain , Palkot, absolutely alone, unarmed, unprotected, I demand you to protect my freedom of expression, speech and movement. Sincerely, Brajesh Kumar Mishra Convenor Attachments : 1. My letter to the Vice President of India 2. My letter to the Prime Minister of India.
