Delhi High Court: Upholding the death penalty to the four accused in the abhorrent and morally deprecating “Nirbhaya gangrape”case, the Court held that the case was the gravest of crime depicting the extreme brutality of the convicts which shocked the conscience of the whole society and gave Delhi the title of “Rape Capital”. It was said that this case provoked an unprecedented reaction from the public and it indeed falls under the yardstick of the rarest of rare category. It was opined that the death penalty needs to be confirmed in this case to deter others from committing such barbaric crime and to give an expression to the societys abhorrence of such heinous crimes. It is important to mention here that there were total 6 accused in this case out of which one had committed suicide and the other being a juvenile was convicted on 31/03/14 and sentenced to 3 years in a reformation home. In the instant case, the victim and her friend with an intention to reach home boarded the ill fated bus at night after being allured by the convicts who pretended that the bus was to ferry the passengers to their destination. The convicts misused the situation to satisfy their lust one by one taking turns to rape the victim and beat the complainant with iron rods. The convicts barbarically inserted rods and hands in the victims private parts pulling out her internal organs, and threw her and the complainant out of the bus in a naked condition. The motive of the convicts was not only to rape the victim but also to kill her. The Court said that because of the irrevocable nature of the death penalty special reasons need to be recorded to uphold the death penalty. Dismissing the appeal against the death penalty the Court said that the depraved acts of the accused in this case call for only one sentence, that is, the death sentence. [State v.
