Democratic Alliance press statement by David van Vuuren DA Chief Whip in the Free State Provincial Legislature and Constituency Head for Setsoto and Mantsopa Local Municipalities Secrecy Bill implemented in Setsoto Local Municipality 20 October 2014 Release: Immediate The Setsoto Local Municipality has embraced the much hated and unconstitutional Protection of State Information Bill, commonly referred to as the Secrecy Bill, by forcing local councillors to sign an ‘Oath of Secrecy’ in order to protect the security of the Republic. The question begs what sort of information within the Setsoto Local Municipality may threaten the security of the Republic? Nothing that local government does within their constitutional mandate, which mostly revolves around the delivery of basic services, can be regarded as secret. DA councillors refused to sign this document. The document claims that any council information can only be accessed through an application under the Promotion of Access to lnformation Act (Act 2 of 2000) and Promotion of Administrative Justice Act (Act 3 of 2000). The objective of this ANC engineered document is to prevent councillors from disclosing any information to any other person without the consent of “the Speaker, Mayor, Municipal Manager or by an Officer named”. We increasingly see how the ANC shamelessly resort to secrecy to cover up its innumerable failures in government. The ANC continues to lose support and as more people realise that the party has an insatiable appetite for the abuse of power and other shady activities that robs them of good governance and quality basic services, the party will resort to unconstitutional behaviour. In no uncertain terms will DA public representatives in the Free State be hoodwinked into signing illegal and unconstitutional oaths of secrecy. The Constitution, Chapter Three, clearly states: 41. Principles of co-operative government and intergovernmental relations: (1) All spheres of government and all organs of state within each sphere must preserve: (a) the peace, national unity and the indivisibility of the Republic; (b) secure the well-being of the people of the Republic; (c) provide effective, transparent, accountable and coherent government for the Republic as a whole; The ANC continues to seek new ways to undermine the Constitution. However, the ANC must take cognisance of the fact that the DA will not allow it to destroy this freedom so many have sacrificed, and, even paid with their lives for.
