Dina Butcher must be getting very bad legal advice. She actually has the law completely backwards. She says that Measure 1 is “fundamentally different” from the Missouri law because Measure 1 is a constitutional provision. For some reason she thinks that a statute, especially one with definitions, is somehow less enforceable than a constitutional measure. The opposite is true. Constitutional measures are almost always statements of general objectives and guides for interpretation. They are not supposed to be specific enough for create liabilities or crimes. That is what statutes are for. The fact that the Missouri law is a statute that did not create the “parade of horrors” makes it even less likely that a state constitutional provision that only expresses principles would lead to a “parade of horrors.” Attorney General Ashcroft made this same point during his visit to North Dakota. inforum/content/ashcroft-nds-measure-1-wont-lead-parade-horrors
