Distress Writs & Abandoned Property Distress Writs A Commercial Landlord has a Landlords lien upon all property the tenant brings upon the rental property. To enforce that lien, the Landlord will have to seek to foreclose upon it as well as seek the issuance of a Distress Writ. The Distress Writ is a writ issued by the Clerk of Court after a Court Order is entered by a judge which directs that no property of the tenant may be removed from the rental property. At the conclusion of the case, the Landlord will seek to sell the tenants property to recover unpaid rent and other sums due the Landlord.
