Divo Katete’s Defilement Case Takes New Twist The matter in which former Kitwe mayor Divo Katete is charged for defiling a girl below the age of 16 has taken a new twist after the father to the juvenile testified in the matter. Particulars of the offence are that Divo Katete, 41, a businessman of House Number 5, 16th Street Nkana East in Kitwe District of the Copperbelt Province on dates unknown but in the month of December, 2012 in Kitwe District allegedly had unlawful carnal knowledge of a girl below the age of 16. Katete is alleged to have defiled a girl below the age of 16 contrary to Section 138 sub-section 1 of the Penal Code chapter 87 as amended by Act Number 15 of 2005 and Act Number 2 of 2011 of the laws of Zambia. Speaking during the cross examination, Cosmos Phiri suspected that his child was sleeping around with other men before the defilement case was reported. “Of late she has changed because she is found with different men, and one day I had to beat her up when I found her with a man I suspect she is going out with,” he said. However, Phiri struggled to explain if he had evidence that her daughter was sleeping around but later told the court that her daughter at one point sneaked out of the house and only came back around 2:00 am. “I have found her on two occasions with one boy in our neighbourhood, the first time the two were exchanging phones while the other they were sitting on the bench together,” he added. “At times she would pretend that she has gone to school but not and spent time with the boyfriend.” When asked what steps he took as a parent, Phiri failed to substantiate his claims that his daughter was always with the named boy who is said to be a footballer. But the investigations officer in the matter Daud Lunda told the court that the available evidence from the hospital clearly shows that the girl was defiled.
