Does justice Mo Ibrahim really appreaciate what a dissenting opinion is? Look at this. In his dissenting opinion in Lemanken Aramat v Harun Meitamei Lempaka & 2 others [2014] eKLR he began thus : I have extensively read the majority decision of the Court and I am unable to agree with it in totality..... In paragraph 181 he summarised his analysis thus. The upshot of the foregoing is that I agree with the majority finding that the petition at the High Court in this matter was filed outside the constitutional timelines of 28 days after the declaration of results. He sums himself at para 187 with the words: As I have agreed with the majority only in respect to the issue of nullity, I endorse all the final orders proposed by the majority as the orders of the Court.
