EPA analyzed its proposed rule expanding the definitions of various bodies to water to increase the number Clean Water permit applications. They concluded there would be little economic impact. How did they do that? First, the data they used to analyze the new definitions didnt follow the new definitions. Predictably, by using the old definition they concluded there would be little change. Their data also assumed the rule intended to increase the number of permit applications wouldnt increase the number of permit applications. That, obviously, produced data showing no increase in costs. EPA then claimed they proved increasing the number of permit applications and expanding their regulatory definitions wouldnt increase costs or scope of regulation.
