Effective immediately!! Legislative & Regulatory Update December 17, 2014 Presidents Bill Signing Suspends Hours of Service 34-Hour Restart Rules THE FOLLOWING ACTIONS ARE EFFECTIVE IMMEDIATELY 1. Removes provision that had limited use of 34 hour restart to once every 168 hours. Now allows use of 34 hour restart any time during a one week period. 2. Removes provision requiring two 1 a.m. to 5 a.m. periods during 34 hour restart. Restart does not have to include two 1 a.m. to 5 a.m. periods to be counted as a restart. The suspension will remain in effect until at least September 30, 2015. During that time, the Federal Motor Carrier Safety Administration (FMCSA) will be required to review its earlier rulemaking of the restart rules to determine if they are effective but also fair to the industry. FMCSA has issued a notice to the public immediately suspending enforcement of the two provisions as required by the law. FMCSA will post a notice on their website and which will also be published in the Federal Register.
