. Effects in absence of Contempt of Courts Act, 1971 – . Even the worst notorious culprits say that they have high respect for Courts; they humbly oblige whatever the verdict passed by the Courts etc. But the real fact behind saying this is the fear of Contempt of Courts Act, the main weapon of Indian Courts. Otherwise: (1). Articles 32 and 226 of the Constitution of India also become useless and ineffective, (2). No Governmental Authority will implement the Courts’ Orders if politicians in power don’t like it, (3). Courts of Justice become toothless and helpless to execute its orders, (4). Implementation of Courts’ Verdicts depend upon the mercy of Politicians and Executive in power, (5). Judges will be also facing widely circulated criticism and abuses similar to that of leveling against Politicians, Political Parties and Executive Authorities, by the people and Media, . At the beginning of 20th Century, Legendary Chief Justice of Federal Supreme Court, John Marshall passed an Order against USA Government for execution. Secretary of Internal Affairs, also namely, John Marshal said “Well, he passed the Order, let him come, implement his order on own” Federal Supreme Court of USA shocked, turned silent, . Of course, Indian Courts of Justice and Judges don’t cause that kind of confusion and inconvenience to Governments. Ruling Political Parties are happy. But, this kind of anarchical situation will arise any time when People lost faith in honesty, integrity and propriety of the Indian Courts. Already Indian Judges, especially those presiding over Courts of Justice are on time bound acid-test.
