Employment Law: Client fired from his job for an alleged misconduct. Client was denied unemployment benefits under 820 ILCS 405/602A. A Notice of Appeal was timely filed with the Illinois Department of Employment claiming that my clients actions did not fit within the elements of Misconduct under the Statute. After argument, the Administrative Law Judge sent in the decision...Because there was no showing that the claimant had disregarded warnings or that the claimant intended to repeat his actions, it could not be concluded that the claimants conduct constituted misconduct connected with the claimants work. The denial of benefits is SET ASIDE. Pursuant to 820 ILCS 405/602A, My client is eligible for unemployment benefits!
