"Even with the jubilation surrounding the defeat of DOMA, this has been a strange and sad week for the Court and the nation. The soaring language of the Warren Court, which had dismantled so many instruments of discrimination—segregation, poll taxes, anti-miscegenation laws—has now been wielded to strike down laws and programs that continue to deal with their vestiges. To four white Justices, discrimination still exists but, from their blinkered perspective, it’s really not so bad. Justice Thomas finds any assistance patronizing and counterproductive. People who live outside the strange hothouse of the Supreme Court right-wing majority know that the reality is very different. Congressman John Lewis, who as a young man was almost killed when Alabama State Troopers attacked civil-rights marchers on a bridge in Selma, said that the Supreme Court should walk a mile in his shoes.
