Evidence Suppressed, Case Dismissed! On June 20, 2014, Michael Duma argued a motion to suppress evidence in Wyandotte County District Court and prevailed in having all the evidence in the case suppressed and in having the case ultimately dismissed. Michael’s client was incarcerated on multiple felony theft charges stemming from the execution of a search warrant on a local Kansas City, Kansas business. After careful investigation of the facts and cross examination of the states’ witnesses at preliminary hearing, Michael uncovered multiple, flagrant constitutional violations in obtaining and executing the search of the business. Michael drafted and argued a motion to suppress the evidence seized from the search. After several evidentiary hearings on the matter, the motion was granted and the entirety of the state’s evidence was suppressed. Ultimately, the state was forced to dismiss its case for lack of evidence.
