Exciting immigration developments concerning temporary visas while Skilled Migrant applications are being processed. Up to now if you have had a Skilled Migrant Residence application in processing and your Essential Skills work visa needed renewing, your employer has had to undertake a labour market check (LMC) – advertising your position and even having to contact Work and Income New Zealand if your occupation is not on a skills shortage list. From 17 November 2014, new immigration changes will mean that no labour market check is required for this specific application. Does this apply to you? - You must currently be holding a temporary visa - You must have either a valid Invitation to Apply or a Skilled Migrant Residence application lodged and currently being processed by INZ. - The new work visa application must be for the same role and employment that is included in your residence application. If you meet these conditions, you will be able to apply for an Essential Skills visa without having to show evidence of your employer’s advertising, provided you meet all other requirements. INZ will then have the option of granting you a 12 month work visa to allow for the processing of your residence application.
