PRANABH MUKHAR JEE TO, Respected Mr. Pranabh Mukharjee Hon’ble President of India President House, New Delhi DATE : 16/12/2014 Sub: Contempt of Settled law is committing by your under secretary Mr. Chairabrata Sarkar not put the Complaint dated 18-07-2014 before you for grant your sanction for prosecution against corrupt Judges of Supreme Court of India namely EX. CJI Mr. P. Sathashivam seating Hon. Judge Mr. Ranjan Gogoi and Hon. Judge Mrs. Ranjan Prakassh Desai if the Complaint under section 6(i) of prevention of corruption Act, 1964 along with your sanction is not sent to the director C.B.I New Delhi for registering first information Report with a week I will file Criminal Writ Petition before Hon’ble Supreme Court against your secretariat for implementation of law. Respected H.E., 1. It is well settled law made by legislature under section 6 (1) of P.C Act 1964 that the Hon’ble President of India is the authority competent to grant his sanction for prosecution of any public servant on ground of corruption, misbehaved and criminal misconduct the law on this point is well settled by Hon’ble Supreme Court in case of K.Veera Swami versus union of India & Others (1991) 3 SSC – 655 laid down as under “59, The Judges of the Supreme Court or The High Court including Chief Justice of India liable to be dealt with just the same way as may other person in respect of criminal offence. It is not only taking bribe or with regard to the offence of corruption, misbehave and criminal misconduct, the sanction of criminal prosecution is required, sanction shall be granted under Section 6 of P.C. Act. The sanctioning authority grant his sanction envisaged by clause (a) (b) and (c) of sub section 1 of section 6 of the P.C. Act. Further held in para 129 of the said judgment as under “129, The inescapable conclusions therefore are that the prevention of Corruption Act, 1947 as amended by the amendment 1964 is applicable of the Judges of the Supreme Court or the High Court. The judges of the Supreme Court and the High Court are public servants within the meaning of Section 2 of P.C. Act. The president of India is treated as competent authority to grant sanction for prosecution according with Section 1 of Act against any judge of S.C or H.C 2. Please take reference to my Complaint dated 18.07.2014 under section 6(1) of PC act, 1947 amended on 1964 read with judges (inquiry) Act, 1968 filed on 23.07.2014 before your honor in which I have prayed to you to grant sanction against 4 Judge of S.C on ground of misbehave, corruption including criminal misconduct as per above settled law and ratio laid dawn by The Hon’ble Supreme Court in Re K. Veera Swami versus union of India & Others (1991) 3. That the applicant has also filed same Complaint under Chapter III of the Judges (enquiry) Bill, 2006 read with Sanction 8 of the Judges (inquiry) Act, 1968 before Chairman National Judicial Council, Supreme Court on 18.07.2014 to conduct investigation in to the ,matter under the above settled law. 4. That you under secretary has clogged his mind and shut his eyes total committed discrimination on ground Gender and race to forward above mentioned Complaint addressed to Hon’ble President of India to the joint secretary, Govt. of India to prolong the matter to save Corrupt Judges for prosecution The action of your Under Secretary is wholly unconstitutional and mockery of the law and Constitution of India. PRAYER It is therefore, most respectfully prayed that my above said complaint may take back to Joint secretary, Govt. of India and forward the same along with you sanction for prosecution to the central Bureau of the investigation, new Delhi according to settled law within a week otherwise I will file Criminal Writ Petition before Hon. Supreme Court against your under Secretary because I am being torturing by Corrupt machinery since over 35 years which has became for me unbearable.
