Family Medical Leave Act FMLA covers all employees who work for employers with 50 or more employees within 75 miles of a given work place. An employee must have worked at least 12 months for the employer and 1,250 hours in the past year to be entitled to the leave benefit. All eligible employees are entitled to a total of 12 weeks of leave during any 12-month period for one or more of the following: 1) birth of a child, 2) placement of child for adoption or foster care, 3) caring for a spouse, child or parent with a serious health condition or 4) the serious health condition of the employee. An employee who takes leave under the FMLA must be able to return to the same job or a job with equivalent status and pay. The employer must continue the employees health benefits during the leave period at the same level and conditions as if the employee had continued to work. An employee can take the 12 weeks of leave intermittently or use the leave to reduce the workweek or workday. If employees have accrued paid leave for less than 12 weeks, they may take the rest as unpaid leave to supplement the paid leave. When an employee plans to take leave under the FMLA, the employee is required to give an employer 30 days notice or, if this is not possible, as much notice as is practicable.
