Collections states Thursday, 8 Jan 15 check on hold, case number allegedly no longer exists. Shortly after Thanksgiving, Collections states three checks cleared, in mail shortly. Prior to Christmas, I spoke to Collections who told me because Medvigy makes his payment, Medvigy is not a problem. I read CA Revenue & Taxation Code 19280 to the clerk: California Revenue and Taxation Code Section 19280 (a)(1) Fines, state or local penalties, restitution orders, or any other amounts imposed by a juvenile or superior court of the State of California upon a person or any other entity that are due and payable in an amount totaling no less than one hundred dollars ($100) ($135,621.00 of $150,000 Ventura Superior (Juvenile,) Court awarded criminal restitution,) i in the aggregate (As in ‘Paid - in - FULL, $150,000, for criminal offenses (Felony Arson, Felony Burglary, Grounds for PERMANENT PAROLE DENIAL LACKING WRITTEN COURT JUSTIFICATIONS…,) no sooner than 90 days after payment of that amount becomes delinquent (Medvigy is delinquent some NINETEEN YEARS, Collections is delinquent One Hundred - Two DAYS of mailing a check to me, surviving victim. referred by the juvenile or superior court, the county, or the state to the Franchise Tax Board for collection under guidelines prescribed by the Franchise Tax Board. Unless the victim of the crime notifies the Department of Corrections and Rehabilitation to the contrary, the Department of Corrections and Rehabilitation may refer a restitution order to the Franchise Tax Board, in accordance with subparagraph (B)of paragraph (2), for any person subject to the restitution order who is or has been under the jurisdiction of the Department of Corrections and Rehabilitation. California Penal Code Section 205 205. A person is guilty of aggravated mayhem when he or she unlawfully, under circumstances manifesting EXTREME(!) indifference to the physical or psychological well-being of another person, intentionally causes permanent disability or disfigurement of another human being or deprives a human being of a limb, organ, or (OR, Any ONE or combination thereof, NOT AND,) member of his or her body. For purposes of this section, it is not necessary to prove an intent to kill. Aggravated mayhem is a felony punishable by imprisonment in the state prison for life with the possibility of parole. 13 Jan 15 Collections now says when they asked for a significant increase in payment, Medvigy hung up his phone. Medvigy says he is not working. 19280, were it enforced, would authorized the CA Franchise Tax Board to MAKE Medvigy get a job. Once employed, Medvigy’s wages would be garnished, proceeds towards payment of Medvigy’s +NINETEEN (19.36 YEAR,) DELINQUENT criminal restitution. 19280 authorizes CA Franchise Tax Board to place a lien on ANY property owned by Medvigy Collections I laugh my head off at the absurdity. Medvigy owes $135,621 of the VSC court awarded $150,000 VSC criminal restitution. With the lawfully renewed judgment (Unlawfully denied by VSC - Juvenile Judge Manuel J Covarrubias, CA Penal Code 1203,) Because Medvigy makes his payments by personal check, Collections tells me Collections is allowed to hold payment thirty (30) days to verify the check clears. As I’ve told Collections for nineteen (19) some years, the money could be withdrawn from Medvigy’s account electronically. If insufficient funds are present, Collections, then sheriff can contact Medvigy. Collections DELINQUENT of payment in full ninety - seven (97,) days (Last payment deposited by myself, 30 Sep 14.) Though Medvigy was convicted for his 31 Dec 14 heinous crime, Both Collections, AND felony Medvigy are DELINQUENT of payment in full. Both Collections and Medvigy are in violation of CA Revenue & Taxation Code 19280 (19280.) Collections claims because Medvigy sends restitution payments as a personal check, Collections is entitled to deny immediate payment to me, victim of FIREMAN / convicted felony ARSON Medvigy. What specific CA Penal Code entitles Collections such pagan behavior? Who receives the interest while my criminal restitution is in a bank account allotted to Collections? Why isnt that interest paid towards myself, and towards other victims? Complaints regarding this ten (10) year DELINQUENCY of Collections fo enforce 19280, other potential acts of embezzlement filed with CA Franchise Tax Board, Federal Internal Revenue Service. Ventura Grand Jury, Commission on Judicial Performance; Ventura Sheriff, Oxnard Police - Internal Affairs complaints submitted 20 Nov 14 will be amended to reflect on these verifiable observations. I would appreciate explanations etal. Should I not call Collections, regardless of employed in Shanghai, China; Wisconsin, long distance phone call, at my expense is necessary to ensure a check to me is sent. I am not reimbursed for interest compounded, nor phone calls, all of which an unnecessary expense by Collections. Collections then MAIL a check to my Post Office box. For twenty - one (21) years Ive advised Collections, VSC - DA all such transactions can / have been done electronically. Why FAXES are the only way to communicate with Ventura Judicial etal, short of mailing certified at an unnecessary expense, in my opinion, is Aggravated Mayhem (CXPC 205.) Collections therefore is DELINQUENT ninety seven (97) days of paying delinquent criminal restitution court order J51111. The most recent payment received by me, 30 Sep 2014. Irresponsibility of Collections to pay me on a timely basis is additional grounds for 19280 be enacted on this case. That 19280 has been law since Jan 2004 is the most significant reason. Failure of Collections to resist enforcement of CA LAWCA Revenue & Taxation Code 19280, in my opinion and pending Ventura Grand Jury, CA Commission on Judicial Performance hearings, is an act of CA Penal Code 205 Aggravated Mayhem.
