Ferguson Investigation Expected to Take Weeks: Grand Jury Could Begin Reviewing Evidence as Early as Wednesday St. Louis County Prosecuting Attorney Robert McCulloch could begin presenting evidence on Wednesday to a 12-member grand jury, which will decide on criminal charges, his office said. The panel, which is selected three times a year at random by a circuit judge, meets once a week. The prosecutor expects his office will need numerous sessions to provide jurors with findings from the Aug. 9 death of Mr. Brown and will try to have the panel start meeting several times a week. Grand-jury proceedings are secret. There are many reasons to hold the proceedings behind closed doors, from protecting those who testify and ensuring their accounts arent influenced by other witnesses to keeping private the names of people who are investigated but not indicted. In Missouri, police can make an arrest if they believe there is probable cause a crime occurred, said Susan McGraugh, an associate professor at St. Louis University School of Law. But prosecutors in the Ferguson case have chosen to have a grand jury determine whether to file criminal charges, which puts the decision in the hands of more people.
