Fact: Trans-national criminal enterprises are expanding their reach into Tx and the US. If anyone is capitalizing on the surge of unaccompanied children (UAC) on the border it is the Trans-national gangs not the Governor. Fact: The care and custody of the UAC is a statutory federal responsibility. When local or state law enforcement and the Guard encounter UAC on the border they are immediately turned over to US Border Patrol. State law enforcement and the Guard are conducting BORDER SECURITY. Fact: The spike in UAC has diverted The Border Patrol from their stated mission of border security to the care and custody of UAC. Thereby creating gaps in border security for Trans-national gangs, human trafficking, drug smuggling, and individuals from terrorists-connected countries. Fact: Many estimate that the spike in UAC, currently at 57k, will reach 90k by the end of the year. In their quest to reach the US, the UAC make the dangerous journey through Central America and Mexico. They attempt to cross the Rio Grande River and risk drowning. They try to negotiate the South Texas desert without water or food. So therefore, having more boots on the ground to encounter these UAC is in fact ensuring the safety of more UAC. Fact: No one, that is, The Governor, state law enforcement, the Guard has asked for arrests powers. Our state law enforcement and Guard are conducting BORDER SECURITY operations to deter and interdict Trans-national criminal gangs, human traffickers, drug smugglers and potential terrorists entries into Tx and the US. Fact: We need members of Congress to empower the men and women of the border Patrol to do their stated mission. Members of Congress through pork barreling restrict the deployment of Border Patrol along the US-Mexico border. Various labor and collective bargaining agreements also influence BP deployments along the border. BP rules of engagement restrict BP response to hostile actions along the border. We may or may not need (I dont think we need a overhaul) immigration reform but this is a federal issue. Yes there is a need for a more effective and humanitarian response to the UAC spike at the border. Again this is a federal issue and the federal government has not asked for any assistance from the State of Texas and when our state law enforcement, health officials, and political leaders have reached out to assist or for information they have been met with muted silence and a bunker mentality. Trans national gangs and terrorists, human traffickers, drug smugglers should be a federal concern as well, but it is a Tx problem, and therefore, Texas must address the problem. To call the law enforcement surge and Guard deployment a stunt is analogous to saying the following: Human trafficking threat is a stunt Drug smuggling is a stunt Trans-national gang and terrorists are a stunt Allowing children to drown in the Rio Grande and die in the desert is a stunt
