Fiscal Court Minutes The Fleming County Fiscal Court held the regular monthly meeting on Tuesday, September 10, 2013 at the Fleming County Courthouse, 100 Court Square, Flemingsburg, Kentucky. The meeting was called to order by Fleming County Judge/Executive Larry H. Foxworthy at 9:00 AM. The magistrates present: Chris Hickerson, David J. DeAtley, John Sims Jr., James Smoot, Rickey Lewis and Ray H. Money. County Attorney John C. Price and County Treasurer Kathy Dryden were also present. Fleming County Judge/Executive Foxworthy led the Pledge of Allegiance. The roll was called by Fleming County Fiscal Court Clerk Tammy L. Gray. Fleming County Jailer Tim Cooper gave his monthly report regarding inmate transports. Vote Unan. Motion: John Sims Jr. Second: James Smoot A motion was made to approve the Fleming County Jailer’s August 2013 transport report. Vote Unan Motion: Ray H. Money Second: Rickey Lewis A motion was made to approve the meeting minutes of August 13, 2013. Fleming County Hospital CFO David Boyer went over the hospital’s financial condition report for the month of August 2013. Mr. Boyer reviewed patient volume, expense and revenue factors. A request was made by Magistrate Lewis to report last fiscal year’s total financial loss at the next meeting. Vote Unan. Motion: Ray H. Money Second: James Smoot A motion was made to approve the second reading and passage of the amended Interlocal Agreement between the Fleming County Fiscal Court and the City of Ewing pertaining to roadway maintenance within the city limits of Ewing. Magistrate Money will attend tonight’s Ewing Council meeting which they should be holding their second reading and passage as well of the Interlocal Agreement. Vote Unan. DeAtley A motion was made to approve the amended first reading of amended Ordinance 11-1106 pertaining to the reapportioning boundaries for Justice of the Peace (Magistrates) for Fleming County affecting: Amendment to District Two (Wallingford, Poplar Plains and Muses Mills): Beginning where the Lewis County and Fleming County lines meet at the head of Ryan Road, following SE down the Rowan County line to the head of Morrison Branch; veering SW to the head of Baxter Branch, crossing Hwy 1013 running up Big Run Road to first left hand lane, following Knob Lick Branch to Farris Branch Road including both sides to Hwy 32 to Littleton Branch, excluding Hamm Road and Hardwood Road; veering W, crossing Hwy 111 to Hwy 1515; veering N to intersection of Hwy 155 & 156, N to end of Allison Creek to Hwy 32 & McCann Road (Secrest Crossing) & intersection of Hwy 559 W before reaching Wilson Run Road, veering N to Flemingburg-Beechburg Road at intersection of Maddox Pike, NE past Arnold Crossing; Beechburg-Wallingford Road (approximately 1 ½ miles); NW taking most of Ross Hollow; SW taking the very end of Pigeon Roost Road veering E approximately ½ mile back to Lewis County line to the beginning. Amendment to District Five (Ringos Mills, Hillsboro, Plummers Landing and Grange City): Beginning at Morrison Branch following the Rowan County border to Bath County, up to Turkey Run Branch Road N to the end of Thurman Lane; veering NE to the mouth of Locust Creek; upstream Locust Creek to KY 1515, up to Locust Creek to junction KY 111 and crossing west taking Franklin Mill (end of Littleton Branch) including Hardwood Road and Hamm Road; veering over approximately ½ mile before getting to KY 32; N to Farris Branch following Knob Lick Branch NE to where its meets Big Run Road, crossing Hwy 1013; veering back NE to Morrison Branch. DeAtley A motion was made to approve the County Judge/Executive’s recommendation to reappoint Bob Gossett for an additional term beginning 9-23-2013 until 9-23-2017 on the Fleming County Cemetery Board. Money Second: James Smoot A motion was made to approve and give the County Judge/Executive the authority to sign and execute any and all documents pertaining to easements along county roadways for the Ewing Sewer Project. Discussion was held regarding the request to assist in fundraising for the Kentucky Mansions Foundation, Inc. which wants to replace the chairs at the Governor’s mansion. Item tabled. Vote Unan. DeAtley Second: John Sims Jr. A motion was made to approve and authorize the County Judge/Executive to sign and execute any and all documents pertaining to the Memorandum of Agreement for Park Lake Mountain Nature Preserve Trails Phase Three. Money A motion was made to authorize the County Judge/Executive to sign and execute any and all documents for the Kentucky Transportation Cabinet Flex Funding Agreement upon receipt. Vote Unan. Money Second: Rickey Lewis A motion was made to approve the August 2013 County Road Maintenance Report as follows: District 1 $ 1,516.91, District 2 $ 134,917.14, District 3 $ 1,762.50, District 4 $ 614.99, District 5 $ 78,584.11, District 6 $ 431.95. Total all districts $ 217,827.60. County Treasurer Kathy Dryden presented the month end August 2013 financial condition reports. General Fund $263,128.46, Road Fund $ 717,993.86, Jail Fund $ 45,764.44, LGEA Fund $ 95,441.56, Dispatch Fund $ 262,529.73, Forest Fire Fund $ 784.72, Revolving Loan Fund $ 88,101.37, Capital Improvement Fund $ 290,667.47. Total all funds $ 1,764,411.61. Vote Unan. DeAtley Second: Rickey Lewis A motion was made to approve the August 21, 2013 polled claim to Darrell Lynch in the amount of $ 7559.16 and temporary transfer of $ 5,000.00 from Road Fund to Capital Improvement Fund until Certificate of Deposit is cashed. Motion: John Sims Jr. Second: Chris Hickerson A motion was made to approve the Fleming County Clerk’s August 2013 monthly report as presented by Jarrod Fritz. Fleming County Dispatch Supervisor Charlotte Benton gave the August 2013 call volume report totaling 491 requests for service. Supervisor Benton also announced the recent award to Jenny Glass for 2013 Kentucky Telecommunicator of the Year at the Kentucky Emergency Services Conference in Louisville last week. Vote Unan. Money Second: John Sims Jr. A motion was made to approve the Fleming County Sheriff Department’s August 2013 monthly report as presented. The 2007 Ford Explorer VIN # 0361 surplus vehicle from the sheriff’s department will be sold at Back’s Auto Auction on September 20, 2013. Publication of sale will be September 11, 2013. Discussion was held regarding the property tax bills issuance and recent school board tax issues. Sheriff Royse stated he was trying to get bills printed for October 1 release but not confirmed. County Judge/Executive announced a recess at 9:52 AM until Duke Renewable Energy arrived for their presentation. Resumed in open session at 9:53 AM. Vote Unan. Motion: Chris Hickerson Second: John Sims Jr. A motion was made to approve the claims report and carry in claims reports. Recessed at 9:54 AM. Resumed in open session at 11:47 AM. Duke Energy Renewables Director of Business Development Graham Furlong showed a power point presentation about the prospective wind energy project in Fleming and Mason Counties. County Judge/Executive Foxworthy announced this presentation was for informational purposes only and it was the first time many have heard much about the project and that at the end of the presentation there would be time for questions. Mr. Furlong stated that this project was in the early stages of development to determine if it would be practical in Fleming County. He reviewed the scope of work that prepared a business model showing development, construction, finance and operational factors as well as market drivers for solar and wind energy projects. Mr. Furlong explained the acquisitions of local land leases have be ongoing for at least one year to conduct early studies, data collection and explore the project’s viability. Interconnection applications have been filed with EKP/PJM as well as working with state and federal agencies to understand the permitting requirements. Mr. Furlong said that estimated construction and commercial operation between 2016 - 2019 and the number of wind turbines is unknown at this time as they continue to collect data and work with local and state officials on permitting. Environmental studies, development of engineering and construction estimates will be ongoing and contingent on approval from KYPSC Merchant Power Siting Board as well as market factors. Benefits for participants, community and environmental were reviewed. Local citizens and elected officials questioned Mr. Furlong about various topics pertaining to safety issues, coal impacts, dimensions of turbines, land leases, decommissioning, on-site monitoring, noise, buffer zones, current low wind projects and investment/production tax credits.
