For the Judiciary to be able to deliver where the government fails there should be no political interference in the appointment and promotion of Judges. The political executive should have no say whatsoever. The Judiciary should not be manned by persons who are slanted or aligned to any political party. Judges should have the spine to crack on illegalities done by politicians in power regardless of the high positions they hold. The law of the land must at all times be upheld. It can be observed that Judges tend to desist from taking on the government especially at times when they are due for promotion or elevation for fear that their prospects may be hindered. Do Judges also develop cold feet to act against the government when they near their retirement due to apprehension that they would not get a plum post retirement nest? If Judges cannot balance the scales of Justice, the temples of Justice become meaningless. The judiciary is the last refuge for the citizens and if this trust is broken, god-fathers lurking in the shadows will have field of a day while people will approach self-anointed messiahs for delivery of justice. Goa’s flamboyant Advocate General Atmaram Nadkarni after having mined Goa deep enough is now surprisingly eyeing a direct elevation as a Supreme Court Judge. It would be the darkest day in India’s Judiciary. The Intelligence Bureau report would reveal the state of affairs which would be more frightening than Dantes Inferno. We would have to hang our Coats and Gowns in shame. God save our Judiciary.
