Former Judge Confirms Obama’s Worst Fears About Huge Obamacare Lawsuit The Affordable Care Act, otherwise known as Obamacare, is headed back to the Supreme Court, this time due to the federal subsidies being extended to low and middle-income enrollees on the federal Obamacare exchange. The lawsuit is challenging the legality of the subsidies, because the specific statute that authorizes such subsidies explicitly says that they are intended only for people enrolled on the state-run exchanges, and not the federal exchange.
