Please replace this undated letter with a dated version. I do not know you personally, and my representation of Frank regarding the attacks against him is in a professional capacity. This letter of expectation was served on Frank on his first day at work after a long absence due to a Workers Compensation disability and just after his mother passed away. This letter’s timing, after his making funeral arrangements, was not only inappropriate but also cruel and inhumane. Please refer to the UC Davis Health System Hospice Bereavement Information: ucdmc.ucdavis.edu/homecare/hospice/bereavement.html “In the first few weeks following a death, the bereavement coordinator, or member of the team, will contact you, to reintroduce the bereavement services available and to assess how you are doing. You will receive a packet of information regarding grief and loss. This packet will include brief literature related to the topic which may prove helpful, along with a listing of bereavement support groups and services in our community. If you and your loved ones are coping appropriately and desire no further assistance, the bereavement coordinator will continue to stay in contact with you throughout the year, either by mail or phone, to remind you that the services are available, if ever you should desire further assistance. “ This should help you understand how the UCDHS Managements threatens family members of these who died at the UC Davis Medical Center versus UC Davis Medical Center employees who lose their loved ones. I found what was done to Frank on September 22, 2014 despicable and unthinkable. This action and previous attacks against Frank clearly affirm that Frank is one of the 24% of UC Davis employees surveyed (4,000 of 11,500) by Rankin & Associates who suffered discrimination, abuse, and/or a hostile work environment (survey published in May 2014). The UC Davis Climate Survey demonstrates the numbers but not what the 4,000 abused and bullied workers suffered while working in a hostile and discriminatory work environment, nor how their families and mental health were affected. I am not quite sure of the goal of serving on Frank a letter of expectation on his first day of work after an absence due to disability and the grieving process. Was it to intimidate Frank and make him drop his pending complaints with HR? Knowing that Frank was emotionally devastated due to his grief and loss, perhaps it was a great opportunity and occasion to make Frank angry and snap at you, requiring that you terminate his employment immediately or send him to the UC Davis Trauma Unit due to a heart attack. Perhaps I should ask about UC HR’s Workers Compensation Manager, Mr. Hugh Parker, who coordinated a similar but unsuccessful action against me on May 31, 2012. In addition to the above, Frank I understood that an alleged violation of Policy 1837 occurred on January 8, 2014, which was resolved via a verbal warning you gave Frank on January 9, 2014. You confirmed the verbal warning on the same day in an e-mail you sent to Frank at 12:30 p.m. (A copy of this e-mail is attached.) You chose to give him a verbal warning instead of a letter of expectation on January 9, 2014. Thus, you should at least have apologized to Frank when he returned to work after his mother’s funeral on Monday for this letter of expectation, and in good faith, you should resolve all differences with Frank without my involvement. You know that Frank is a good person and a good employee and that he does not deserve to be treated by management and HR as a subhuman or a piece of garbage. On top of this, your verbal warning given to Frank on January 8, 2014 and undated Letter of Expectation served to Frank on September 22, 2014 have no merit and are legally groundless. On January 8, 2014, Frank used the company truck to drive to a FedEx Office to fax the amended letter of expectation to his representative; you served him on this day, but it was a strictly work-related issue. (See date and time of faxed copy of the attached letter of expectation.) Frank does not use the company truck for private use as do UCDMC supervisors and managers. You attacked him in this amended latter of expectation on January 8, 2014. You intimidated him and made him fear for his job security. He then called me several times, and I advised him to fax the letter and that I would look into it. This is the end of the story. Sincerely, Jaroslaw Waszczuk, Representative for Frank Gonzales CC: as in email Attachments. ************************************************************************************************************ -----Original Message----- From: Jaroslaw Waszczuk [mailto:jjw1980@live] Sent: Tuesday, September 23, 2014 8:51 AM To: Frank Gonzales Subject: RE: Letter of Expectation Hi Frank Sorry to hear about your mother and what you going through .
