From the Kanawha Forest Coalition CALENDAR ITEMS: -Our next Kanawha Forest Coalition meeting will be this Thursday, July 31, 5:30 pm at the Kanawha United Presbyterian Church (1009 Virginia St E, Charleston). Come on down and help us plan the petition delivery and other upcoming actions and events. -The final Surface Mine Board hearing on our appeal will be Monday August 11, 8:30am at the DEP building in Kanawha City (601 57th St SE). We will meet in the main lobby and they will escort us back to the hearing room. It would be great to have a good turnout there. If the SMB fails to rule in our favor at this hearing, we will be filing a lawsuit the following week. UPDATES: -LEGAL: We Filed a Motion for Stay with the Surface Mine Board (SMB) and that hearing took place last Thursday. We were asking the SMB to stop work on the KD2 mine until the August 11 hearing. This Stay request was based on the likelihood of imminent harm to endangered bat habitat. We also discovered that the State Historic Preservation Office (SHPO) had never signed off on the permit as required by WV Code Chapter 22, Article 3, Section 22(d)(2). The SBM denied our request for stay. Final hearing is August 11th, as noted above. -PETITION: The petition calling on Governor Tomblin to rescind the KD#2 permit now has nearly 3,500 signatures.
