Dear Mr. Chapinski : Thank you for contacting me to share your views regarding unaccompanied immigrant children entering the United States. I appreciate the time you took to write, and I welcome the opportunity to share my views. As you may know, there has been a rise in immigrant children under the age of 18 who are being apprehended at the U.S.-Mexico border without a parent or legal guardian. According to U.S. Customs and Border Protection, 66,000 such children were apprehended between October 1, 2013 and August 31, 2014 – a number which is almost twice as high as previous years. The Pew Research Center found that nearly 75% of these children come from Central America, often fleeing violence and poor economic conditions in their host countries. However, you may be pleased to learn that the number of unaccompanied children apprehended along the southwest border has declined by nearly 70% since June 2014. I understand you are concerned that such a high number of unaccompanied children are attempting to enter the U.S. I also recognize that you believe that the Federal government has encouraged these children to leave their home countries through deferred action programs and comprehensive immigration reform efforts. You may be interested to know that these children are not eligible for temporary legal status under the Deferred Action for Childhood Arrivals (DACA) program, as only children in the U.S. prior to 2007 are eligible. In addition, to dispel any misinformation and misunderstanding of our laws abroad, I led a bipartisan letter with Senator Jeff Flake and 40 other Senators to President Obama urging him to clarify that those who do not warrant protection under U.S. and international law would be returned to their home countries. The Administration has taken action and increased deterrence by collaborating with leaders of Central American countries to aggressively publicize the risks of the dangerous journey to the U.S., enhancing enforcement along our southern border, and clarifying that those who do not qualify for humanitarian relief will not be permitted to remain in the U.S. I support responding to this situation in a humane, effective, and just manner. I also recognize that the recent increase in numbers of unaccompanied minors along the U.S.-Mexico border is unprecedented and that the situation is an exceptional circumstance that may warrant a temporary change in how the law is implemented. I believe that the Administration has the flexibility needed to appropriately manage this situation under current law. Again, it is helpful for me to know your views. While we may have different perspectives on the treatment of unaccompanied children, please know that I will keep your views in mind as this situation continues to develop.
