Gardens On the 1st of October 2014 the Alien and Invasive Species Regulations, which covers a variety of fauna and flora, came into effect. Regulation 29(3) imposes a duty on the seller of any immovable property to notify the Purchaser in writing, PRIOR to the conclusion of the sale agreement, if there is any of the listed invasive species are present on the property. YES NO Due to the fact that this must be in writing and before the conclusion of the sale agreement, it would not be practical to add a clause to an agreement of sale. It is however recommended that the following is added to the Sellers declaration: Is the Seller aware of any invasive species on the property? It is worth mentioning that Regulation 29(1) and 29(2) stipulate that if a permit-holder sells the property on which a specimen of an alien or listed invasive species is under the permit-holders control, the new owner must also apply for a permit which will be on the same conditions as the previous permit unless specific circumstances require the conditions to be revised.
