Group input needed: Group input needed please: In December 2013 I split with my exN. After months of telling him I wanted our relationship to be over due to emotional and verbal abuse. The weekend I was booted out of our house, he took our then 2 year old daughter to a neighbors house claiming that I was going to leave the state with her. I spent a weekend without her and both of us went to court the following monday to file ex-parte motions against eachother. The comissioner ruled that she would stay with me during the week in my mothers one bedroom apartment, and exN would get weekend visitation...a hearing was set up for December 26th. During that time period, the exN lost control and texted, emailed, called and verbally assaulted me daily. He prevented me from going to the house to get my personal belongings, insisted on being there if I did go, and would again verbally assault me. In the process he stole my personal journals dating back 15 years to take his step-sisters who is a family attorney. He threatened that if I didnt settle out of court he would present a devastating case against me saying that I was suicidal and depressed and he would get majority custoday. At this point I did not have access to an attorney and was scared. I agreed to strike the hearing and draft a temporary parenting plan, on yellow legal tablet in my own handwriting. The agreement basically said that we would follow a 51/49 percentage custudy, with the agreement that he would go to counselling...he had me put if needed. I wanted the plan to be a 3 month trial period...he had me put at the end of which we would keep the 51/49 and only change the calander days. No official order was entered into the court, and the 3 month period passed, which of course was a disaster. In April after he decided to start keeping her for an extra night against my wishes, I filed a motion for temp orders, wanting majority custody, with a declaration from his biological sister stating the abuse they endured as children, (he was water boarded), and how much of a bully he has been thoughout his life. I found an attorney now who has been willing to do a lot of work pro-bono and for trade. Because of this, I feel shes not giving it her best effort at times. Last month, his attorney filed a motion to enforce the contract in response to my temp orders and drew out the process. We are supposed to head to mediation, and that order says we will have to follow the 51/49 agreement although the commissioner said that was a matter for mediation/trial. My question is...how do I fight this. This man is a pure narcissist and I just cant fathom a life of dealing with it. I am at my wits end ready to give up the fight. I am not from this area, I want to move back to where Im from, Im living in a one bedroom apartment, barely surviving because hes offered no support. Sorry for the long winded post...any advice would be extremely helpful!
